REGULATIONS CONCERNING THE REWARDS PROGRAM ENTITLED "MILLEMIGLIA PROGRAM" PROMOTED BY ALITALIA – SOCIETÀ AEREA ITALIANA S.P.A. IN E.A. AND ALITALIA LOYALTY S.P.A. ("PROMOTERS") EDITION JANUARY 1, 2018 – DECEMBER 31, 2018.
ART. 1 – DEFINITIONS AND GENERAL PROVISIONS
1.1 Pursuant to and in accordance with these Regulations, terms shown with an initial uppercase letter have the following meaning:
"Alitalia Loyalty" refers to Alitalia Loyalty S.p.A., with registered office at Piazza Almerico da Schio, 3, Bravo Building, Fiumicino (RM), with fully paid up share capital of EUR 500,000.00, tax code, VAT and registration number in the Companies Register of Rome 12231871000, R.E.A. (Repertorio Economico Amministrativo - Economic and Administrative Index) RM-1359262.
"Alitalia" refers to Alitalia – Società Aerea Italiana S.p.A. in extraordinary administration with registered office at Via Alberto Nassetti snc, Pal. Alfa, 00054 Fiumicino (RM), with fully paid up share capital of EUR 103,105,126.99, tax code, VAT and registration number in the Companies Register of Rome 13029381004, R.E.A. (Repertorio Economico Amministrativo - Economic and Administrative Index) RM-1418603.
"Promoters" refers to Alitalia and Alitalia Loyalty.
"Co-Holders" pursuant to Article no. 28 of Legislative Decree 196/2003 (Privacy Code) refers to Alitalia and Alitalia Loyalty.
"MilleMiglia Program" or "Program" refers to the correspondent rewards program, the aim of which is to promote loyalty among the Promoters' customers, effective from January 1, 2018 to 31 December 2018, unless extended.
"Program Communications" refers to all communications relating to the Program published on the website www.alitalia.com from time to time and/or in other media relating to the Program (such as brochures, e-magazines and newsletters).
"MilleMiglia Regulations" refers to the terms and conditions contained in this document, on the website www.alitalia.com and/or in the Program Communications that rule the operation of the MilleMiglia Program.
"MM" is the acronym that refers to MilleMiglia.
"Miles" refers to the Program's unit of measurement.
"Reward" refers to the air ticket or other rewards that may be obtained using the Miles earned in compliance with the procedures set out in these Regulations, on the website www.alitalia.com and/or in the Program Communications.
"Airline" refers to Alitalia – Società Aerea Italiana S.p.A. in a.s.
"SkyTeam Airline" refers to a Partner belonging to the airline carrier alliance established on June 22, 2000 denominated SkyTeam and referred to in Appendix A, available on the website www.alitalia.com.
"MilleMiglia Card" refers to the loyalty plastic card issued by the Promoters.
"Member" refers to a natural person who joins the Program by subscribing and accepting the MilleMiglia Regulations and whose name is on the MilleMiglia Card.
"MilleMiglia Code" refers to the personal numerical code issued to the Member that subscribes to the MilleMiglia Program.
"Exclusive Clubs" refers to the "Ulisse Club," "Freccia Alata Club" and "Freccia Alata Plus Club".
"Qualifying Miles" refers to the Miles that enable Members to join or to renew membership of the Exclusive Clubs.
"Qualifying Flights" refers to all flights flown with fare class tickets for which Qualifying Miles may be earned.
"Crediting of Missing Miles" refers to the crediting of Miles to a Member's account after the time at which such crediting would usually take place automatically.
"Co-branded Card" refers to the plastic card, which may be used as a loyalty card and a credit card and to which defined associated benefits may be linked.
"Alitalia BusinessConnect," "BusinessConnect" or "ABC" identifies the MilleMiglia Program section dedicated to Companies (as defined below).
"Company" refers to a legal entity, individual enterprise, VAT registration number, professional, sports or religious association.
"Administrator" refers to the Company’s contact person.
"Company Code" refers to the code assigned to the Company for its participation in Alitalia BusinessConnect and for earning Miles for flights with Alitalia flight codes.
"BusinessConnect MilleMiglia Code" refers to the code assigned to the Company to manage Miles, earn Miles with Commercial Partners and claim Rewards.
"PIN" (Personal Identification Number) refers to the secret personal code that allows Members and Companies to access the dedicated Program section and other online services on the website www.alitalia.com.
"General Conditions of Carriage (or GCC)" refers to the conditions of the contract governing the provision of general economic interest services, consisting of the carriage of passengers and baggage, which may be viewed on the website www.alitalia.com.
"Itinerary receipt" refers to a document certifying the issue of an electronic ticket (known as an "e-ticket").
"Customer Center" refers to the telephone service for Members (as defined below) to obtain information, make bookings and obtain tickets, Rewards and assistance.
"BusinessConnect Customer Center" refers to the telephone service for Companies to obtain information, make bookings and obtain tickets, Rewards and assistance.
"MilleMiglia Gallery" refers to the online catalogue that enables Members and Companies to use Miles earned to claim products and services other than Award Tickets, Upgrades and Cash & Miles.
"Loylogic Inc." refers to the Company appointed by the Promoters to manage the MilleMiglia Gallery rewards catalogue and to carry out the activities and functions needed for Members to claim the Rewards contained in such catalogue.
"Points International Ltd." or "Points.com" refers to the company based in the Province of Ontario, Canada, authorized by the Promoters to manage the assignment and transfer of Miles when Rewards are claimed.
“Ancillary” means additional goods and services supplied by Promoters, available on flights operated by Alitalia that must be paid by the Member.
"Partner" refers, instead, to an airline, company or organization that carries out activities other than air transport (also defined, in this case, as Commercial Partner), which is associated with the Program and listed in Appendix A.
1.2 Terms defined in the singular have the same meaning in the plural and vice versa.
1.3 Members' or Companies' participation in the Program is free of charge and subject to acceptance of these Regulations. By joining the Program, Members or Companies accept these Regulations in full and any changes to them.
1.4 The Promoters reserve the right to modify at any time, in full or in part, the present Regulations, the terms and conditions of participation in the Program, the Rewards, the tables for earning and using Miles, the system for earning Qualifying Miles and the participation of any Program Partner. Any change or addition will be communicated promptly to Members and Companies through publication on the website www.alitalia.com and/or through Program Communications. Members and Companies do not have the right to claim any refund or compensation from the Promoters with regard to changes required by law or otherwise in compliance with applicable rules.
1.5 Further information on the Program may be obtained via the MilleMiglia section of the website www.alitalia.com or by phoning the Customer Center (for Members) or the BusinessConnect Customer Center (for Companies) on the numbers specified on the website www.alitalia.com and/or in the Program Communications.
ART. 2 – BENEFICIARIES
Beneficiaries of rewards are all end consumers, i.e. natural and legal persons that purchase goods and services offered within the MilleMiglia Program in accordance with the conditions set forth in the present Regulations.
ART. 3 – CONDITIONS OF MEMBERSHIP AND PARTICIPATION FOR MEMBERS
3.1 All natural persons of at least 14 years of age who are paying passengers on flights with Alitalia and/or with Partner Airlines and/or who have bought goods and services from the Promoters and/or Partners, are eligible to participate in the Program. The validity of the registration is subject to the provision of a postal address (which will also be considered by the Promoters as the Member's place of residence solely for the purposes of participation in targeted promotional initiatives) to which the MilleMiglia Card will be sent, and the provision of a personal email address, to which the MilleMiglia Program correspondence will be sent. Registration for the Program by dependent minors is subject to the express approval of their parents or those with parental authority and is subject to their responsibility.
3.2 To join the Program, you must register on the website www.alitalia.com or contact the Customer Center or through the other channels communicated by the Promoters from time to time. Registration for the MilleMiglia Program requires that these Regulations have been read and accepted in full. With regard to membership of one of the Co-branded Cards, which require registration in the Program, customers may register for the Program by filling out a special form containing personal details to be sent to the Promoters or financial Partners who promote the Card.
3.3 Each registration is made under the name of a single Member and requires the Member to provide his or her own personal information and to notify any changes thereof via the website or by contacting the Customer Center. Members ensure the accuracy of all information provided to the Promoters and are solely responsible for it. It is not possible to register more than one person under the same personal numerical code or the same account. If multiple codes or accounts are registered to the same Member, the Promoters will, prior information to the Member, transfer the balance of the Miles earned to a single account and close the other accounts. In such a case, if Miles relating to the same flight/service have been credited to multiple accounts in the name of the same Member, they will be credited exclusively to one valid account.
3.4 Upon registration, Members are provided with a personal numerical code (the MilleMiglia Code), which shall be provided whilst booking flights and checking in at the airport for the relevant number of Miles to be credited. The personal numerical code identifying each Member corresponds to an account to which earned Miles will be credited: (i) resulting from flights actually taken with Alitalia (i.e. "flown"), using paid air tickets (not Award Tickets) (ii) resulting from flights actually taken with Partner Airlines using paid air tickets (not Award Tickets), (iii) resulting from the use of goods and/or services provided by Promoters, and (iv) from the purchase of products and the use of goods and/or services provided by other Partners, in accordance with the terms and conditions set out on the website www.alitalia.com and/or in the Program Communications.
3.5 Furthermore Members will receive, via their own email address, the PIN needed to access the services, as well as the specific instructions for doing so. Members bear sole responsibility for the confidentiality of their own PIN and Promoters will not be liable in any way for its fraudulent use.
3.6 Members will be provided with a MilleMiglia Card bearing their personal data and MilleMiglia Code after their first flight with Alitalia and/or Partner Airlines, and/or other activity they carry out with Commercial Partners. The MilleMiglia Card bears the Member's name and may only be used by its holder. The Card remains the property of the Promoters and must be returned if requested by them or if the Member withdraws from the Program.
3.7 In the event that the MilleMiglia Card is lost, stolen or damaged, the Member must notify the Customer Center promptly. The Customer Center may then re-issue the card or close the corresponding account and open a new account to which all Miles earned will be transferred. In such an event, the Member will receive a new code, a new MilleMiglia Card and a new PIN. However, the Promoters will not be responsible for any fraudulent use of the lost or stolen MilleMiglia Card. If they lose their PIN, Members may have it sent again to the email address in their profile, using the special online request function, available on the website www.alitalia.com. To this end, Members should always keep their personal profile and email address up to date. For security reasons, once a PIN has been retrieved, Members should change their PIN using the information update function provided on the website www.alitalia.com. If Members cannot use this function or do not receive the PIN requested, they may contact the Customer Center, which will provide the necessary assistance.
3.8 Each Member's accounts is personal and in their name, meaning that Members cannot have or use Miles earned by any other person, including any heirs. In the event of the death of the Member, his/her heirs are invited to send the related documentation in order to allow the cancellation of the registration and the MilleMiglia membership card.
3.9 The Promoters reserve the right to offer promotional initiatives to specific groups of customers. By participating in such promotional initiatives, Customers may receive a number of benefits in addition to those provided for by the Program.
3.10 Program Members may also subscribe to the "Social Login" service, which gives them access to all MilleMiglia services using the access credentials of their favorite social network. The personal data provided when subscribing to the service is collected and recorded by the Promoters in paper, electronic and/or computer and/or telematic formats and is protected and processed via appropriate means for ensuring security and confidentiality in accordance with the provisions of Italian Legislative Decree no. 196 of June 30, 2003 on personal data protection.
3.11 The Promoters reserve the right to deny Program participation to those who do not meet the requirements set out in these Regulations or to exclude them from the Program if failure to meet the above-mentioned requirements is subsequently revealed. If registration for the Program or participation in it should contravene the applicable provisions of the Regulations, the Promoters reserve the right to revoke the Member's registration and to cancel the Miles earned that have yet to be redeemed at the time the revocation is communicated, as well as to void any Rewards previously obtained but not yet redeemed.
3.12 Members who were registered for previous MilleMiglia Programs shall continue by rights to be registered for the new Program, without prejudice to their right to request cancellation. Members may leave the Program at any time. In such a case, Members will be able to use the Miles earned to that point to claim a Reward; any residual Miles will be canceled at the time of withdrawal. Members must request withdrawal from the Program in writing, specifying their personal numerical code and attaching a copy of a valid, countersigned document, sending it to the email address email@example.com.
ART. 4 – MILES FOR MEMBERS
4.1 Miles are the basic calculation unit used by the Promoters for the Program. Members earn Miles on the Airline's flights and on those of the Program Partner Airlines, as well as when purchasing the goods and services of Promoters and Commercial Partners. Members earn Miles on all flights operated by SkyTeam Airline carriers, including code-sharing flights, and on Alitalia code-sharing flights with other Partner Airlines. Code-sharing flights operated by Alitalia and/or other Partner Airlines in association with airlines that are not Program Partners do not entitle Members to earn Miles.
4.2 The number of Miles earned from flights is calculated on the basis of (i) the IATA TPM (Ticketed Point Mileage) or (ii) on the fixed number of Miles established by the Programme between the point of departure and arrival of the specific flight, (iii) on the basis of the booking class used and (iv) the type of fare chosen, that indicates the cost level of the flights. For multi-leg flights, Miles are credited in relation to individual legs. The number of Miles credited is specified in the miles earning tables available on the website www.alitalia.com and/or in the Program Communications, which are in force at the time the ticket for each leg is used. The content of these tables is only valid for the period specified on the website www.alitalia.com. The services provided and the products offered by Partners that are eligible for Miles are specified on the website www.alitalia.com and/or in the Program Communications.
4.3 To have Miles credited automatically, Members must quote their personal numerical code when booking flights and must show their MilleMiglia Card when checking in at the airport. It may not be possible to credit Miles automatically at some airports. If Miles are not credited automatically, Members are entitled to a Crediting of Missing Miles by submitting a request within four (4) months of taking the flight to which the Miles refer, as specified on the website www.alitalia.com and/or in the Program Communications. If the services or products of a Commercial Partner are used, Members must quote their personal numerical code when booking the service or purchasing the product. If Miles are not credited for a service or product offered by a Partner, it will be necessary to contact the Partner's Customer Center directly.
4.4 In the event that a Member is also registered with another Partner Airline's loyalty program and flies with one of those Airlines, he will not be able to have duplicate Miles credited to the account of that Program as well as to the account of this Program. If the Promoters establish that a Member has fraudulently obtained duplicate Miles, they reserve the right to void the unduly credited Miles, to exclude the Member from the Program, to void any Rewards obtained previously that have not yet been used and to claim for any damages.
4.5 In the event that a Member is registered with another Partner Airline's loyalty program and has earned Miles on the MilleMiglia Program, under no circumstances may he proceed in transferring Miles for credit with the account of the Partner Airline and/or vice versa.
4.6 Any tickets purchased but not used are not eligible for Miles. Miles due for using air transport services are credited to the Member's account only after the flights have been actually taken.
4.7 The purchase of Ancillary services available on flights operated by Alitalia entitles the Members to earn miles, if specifically indicated on the website www.alitalia.com, in the MilleMiglia section.
4.8 Any flights purchased by Members but used by others are not eligible for Miles.
4.9 The purchase and transfer of Miles between different accounts is not permitted other than as expressly provided for in these Regulations and stated on the website and/or in the Program Communications.
4.10 The Promoters reserve the right to undertake promotional initiatives or enter into specific agreements through which Miles may be awarded on different grounds and in addition to those provided for in these Regulations. Any such initiatives will be communicated through the website www.alitalia.com and/or through the Program Communications.
4.11 Miles obtained from using Commercial Partner services or products are governed by the rules communicated by these Partners, which are usually posted on their websites (see the links in Appendix A).
4.12 Miles may not be earned with flights taken using Award Tickets.
4.13 Miles may not be earned on some special fares and/or booking classes on the Airline's flights and/or Promoters' services and products and/or Partner services or products with particularly discounted rates/prices. The Promoters do, however, reserve the right to award Miles for these special rates/prices during specific promotional campaigns, of which Members will be suitably notified.
4.14 Miles may not be earned and the benefits of Exclusive Club membership may not be received from flights flown free of charge or with discounts of over 40% on the applicable fare (excluding taxes and supplements) and/or identified by discount codes ID and AD. Any Miles credited from these flights will be canceled.
4.15 Miles will not be credited for flights taken with airlines that are not Program Partners, even if originally booked through the Airline or for a ticket issued for the Airline. However, if one of the Airline's flights is canceled within 36 (thirty-six) hours of departure and the flight is rebooked with an airline that is not a Program Partner, the Member will still be entitled to earn Miles of the originally booked flight.
4.16 Charter flights are not eligible for Miles.
4.17 Program Partners are the only parties responsible for the conditions for awarding Miles following the use of their services or the purchase of their products and the related credit. Members who wish to use Partner services or products are required to check current applicable conditions with the Partners. The Promoters assume no liability for services or products offered by its Partners. Any related complaints must be addressed directly to the Partners.
4.18 Miles must not be traded by Members nor auctioned or converted into cash. The brokering of the purchase or sale of Miles, the transfer of Miles and the purchase of Miles are also forbidden, except where expressly provided for in the Program regulations published on the website www.alitalia.com and/or in the Program Communications. In this regard, to enable Members to reach the number of Miles needed to obtain Program Rewards, Members who have duly registered for the Program may buy, give or transfer Miles for themselves or for other registered Members by going to the MilleMiglia section of the website www.alitalia.com, where they will have access to the portal of Points International Ltd.
4.19 Members may not sell or trade their Miles in any way, except where expressly provided for in these Regulations and stated on the website www.alitalia.com and/or in the Program Communications. Similarly, Members may not sell or trade the advantages and benefits obtained through the Program, except where expressly provided for in these Regulations and stated on the website www.alitalia.com and/or in the Program Communications.
4.20 Miles earned by Members are detailed on their statements, which may be viewed on the website www.alitalia.com. Members are responsible for checking their own statements and any complaints will be accepted only if they refer to activities in the month prior to the date of the complaint. The statement is considered to have been approved one month after the last activity. In any event, the Promoters reserve the right to not award or to cancel Miles that are mistakenly credited at any time.
4.21 In the event of a free upgrade to a higher class, awarded by the Airline or one of the Partner Airlines for operational reasons, Members will be credited for the Miles according to the travel class shown on the ticket rather than the class actually flown.
4.22 After a 24 (twenty-four) month period, during which the Member has not carried out any activities that earn Miles, the Miles will be considered expired and the Promoters will cancel them from the Member's account. Members are responsible for checking the expiration date of their own Miles. The Promoters are not required to communicate the cancellation of Miles pursuant to the above provisions.
4.23 If after five years from the date when the account was opened there is no activity registered to the Member's card, the Promoters reserve the right to cancel the Member's account. The Member will have the right to re-register with the MilleMiglia Program at any time.
4.24 This Reward operation allows one to earn Miles up to the expiry on December 31, 2018. Reward can be requested by the Member until January 31, 2019 and will be awarded to the rightful owner at the same time, with the exception of any Rewards that must be delivered to the Member's home, in which case the regulations specified on the pages relating to such initiatives on the websites www.alitalia.com and millemigliagallery.com will apply.
ART. 5 – MILES EARNED FOR FLIGHTS TAKEN BY MEMBERS' CHILDREN
5.1 Members with children between 2 and 13 years of age may earn Miles on their own account for Alitalia flights flown by their children.
5.2 Each child between 2 and 13 years of age may be linked to the MilleMiglia Code of one parent only, with the prior agreement and authorization of the other parent.
5.3 Each Member may also, as a parent, have more than one child linked to their account.
5.4 To activate this initiative, the parent must fill out the form on the website www.alitalia.com. It can take up to thirty (30) days to assign the child's identification code and activate the promotional initiative in the system while the necessary checks are carried out. Where the email address provided by the Member at the time of registration with the initiative is different from the address held in the Member database, the latest email address provided will replace the previous address. The new address will be used for all future Promoter communications.
5.5 The Miles that the child earns for each single flight will only be credited to the account of the parent (Member) that the child is linked with, and only for flights taken after the identification code assigned to the child has been provided, and according to the MilleMiglia Program regulations in force at the time of the flight, up to a maximum of 100% of the Miles flown (= base Miles), even if the fare has a higher mileage value. Miles may not be earned for flights taken by children with promotional fares that would have a mileage value of up to 100 Miles.
5.6 Miles earned with flights taken by children are never Qualifying Miles that may be used to join or renew membership of the Exclusive Clubs.
5.7 Parents may not earn promotional Miles on flights flown by the child. The child's flight activities are not included in any promotional initiative proposed or launched by the MilleMiglia Program and/or by the Promoters unless expressly specified otherwise.
5.8 Miles are credited to the parent's account whether the child flies unaccompanied, with the parent or with a third party. If Miles are not credited, a Crediting of Missing Miles may be requested, as provided for in these Regulations.
5.9 Once the child turns 14 years of age, the link with the parent's MilleMiglia account will automatically expire. For the first activity, the parent or person with parental authority may register the child on the Program by providing the child's identification code. From then on, the child's identification code will become his or her own MilleMiglia Code and Miles will be credited directly to his or her account.
5.10 For anyone under 18 years old, registering for the MilleMiglia Program and providing personal data is subject to the consent and responsibility of parents or those with the relevant authority.
5.11 The Promoters decline all responsibility for any false information provided by Members, punishable pursuant to Articles 483, 495, and 496 of the Italian Penal Code and applicable laws.
ART. 6 – EXCLUSIVE CLUBS FOR MEMBERS
6.1 Achieving membership of and participating in the Exclusive Clubs is reserved to Members who are natural persons and not to Companies. Members who earn the required number of Qualifying Miles or Qualifying Flights specified on the website www.alitalia.com and/or in the Program Communications are automatically registered for the Ulisse Club, the Freccia Alata Club or the Freccia Alata Plus Club, free of charge. Qualifying Miles may be obtained from January 1 to December 31 of each year of the Program by taking flights with the Airline or SkyTeam Airlines or other Partner companies, where expressly indicated. Exclusive Club membership involves the Promoters granting the benefits and advantages specified on the website www.alitalia.com and/or in the Program Communications. The Promoters reserve the right to modify these benefits and advantages at their sole discretion for the duration of the Rewards program, duly notifying Members of this with sufficient notice. The Promoters reserve the right to modify and/or revoke the status of "Freccia Alata Plus Per Sempre" Member for both new and existing Members, giving Members at least six months' notice. In addition to the above, the Promoters reserve the right to allow particular Member categories to participate in the Ulisse Club, the Freccia Alata Club or the Freccia Alata Plus Club or for specific promotional initiatives.
6.2 Registration in the Ulisse, Freccia Alata and Freccia Alata Plus Clubs is valid until March 31 of the second year after the year in which the Qualifying Miles were earned or the Qualifying Flights were taken for the granting of membership status, except when a different date is expressly specified relating to specific promotional initiatives.
6.3 The Qualifying Miles needed to access the Exclusive Clubs simply represent the reference threshold for entry to the Club, which does not affect the option to use the Miles earned for claiming Rewards as the Qualifying Miles are not deducted from the Member's account at the time of access to the Exclusive Club, unless otherwise stated in relation to specific promotional initiatives.
6.4 Member status of the Ulisse, Freccia Alata or Freccia Alata Plus Clubs is granted from the beginning of the month following the acknowledgment of the necessary Mile threshold being reached in the Program management systems.
6.5 It is possible that Club Ulisse, Freccia Alata or Freccia Alata Plus status may not be assigned to a Member if his/her account is in the phase of revision or if the Member is subject to a flight prohibition or if the Miles or the Qualifying Flights were obtained by violating the conditions of the Regulations.
6.6 The benefits associated with the Ulisse, Freccia Alata and Freccia Alata Plus Club status are not granted to Members of the MilleMiglia Program in the cases provided for in Article 4.14. 6.7 The Promoters reserve the right, at any time, to give Members the option to pay for access to one or more of the Exclusive Clubs.
ART. 7 – CONDITIONS OF MEMBERSHIP AND PARTICIPATION FOR COMPANIES
7.1 Companies with registered office or domicile in Italy or in a country listed in the enrollment form published on the website www.alitalia.com and/or in the Program Communications —with the exception of travel agencies, tour operators and companies that already entered into a commercial agreement with Alitalia — which travel by air via purchased Alitalia flights, may take part in BusinessConnect. The validity of the registration is subject to communication of the Company’s information (VAT number or other equivalent identification number, postal address and email address for Program correspondence, full name and date of birth of the Administrator).
7.2 The Administrator is the Company's contact person, who must be specified during the registration stage. The Administrator will manage the Company's MilleMiglia Program account.
7.3 To join BusinessConnect, you must register via the website www.alitalia.com via the dedicated page or use other channels communicated by the Promoters from time to time. Registration for the Program requires that these Regulations have been read and accepted.
7.4 Following registration, the Company will be given two numerical codes: a Company Code to earn Miles with Alitalia tickets and a MilleMiglia BusinessConnect Code to manage the Miles, earn Miles with Commercial Partners and claim Rewards. To earn Miles for flights taken with Alitalia and the Partners, the Company Code must be provided when booking and purchasing the flight. The MilleMiglia BusinessConnect Code identifying each Company corresponds to an account to which earned Miles will be credited from flights purchased and taken with Alitalia or Airline Partners (i.e. "flown") using paid air tickets, in accordance with the terms and conditions stated on the website www.alitalia.com and/or in the Program Communications.
7.5 The Administrator, specified during the registration stage as the Company's representative, will also be sent, via the email address provided, the PIN needed to access the dedicated services, as well as the specific instructions for doing so. The Administrator bears sole responsibility for the confidentiality of the Company's PIN and Promoters will not be responsible in any way for its fraudulent use.
7.6 If the PIN is lost, the Administrator may recover it using the relevant function on the website www.alitalia.com. The Administrator should keep the Company's email address up to date at all times for this purpose. For security reasons, when the PIN has been recovered, the Administrator should change it using the relevant information update function on the website www.alitalia.com. The Administrator should also change the PIN on a regular basis, using the relevant information update function on the website www.alitalia.com. If the Company, via the Administrator, cannot use this function or does not receive the PIN requested, it can contact the BusinessConnect Customer Center, which will provide the necessary assistance.
7.7 Each registration is made under the name of a single Company and requires the Company to provide its data and to notify any changes thereof by contacting the BusinessConnect Customer Center. The Company ensures the accuracy of all information provided to the Promoters and is solely responsible for it. It is not possible to register several Companies under the same MilleMiglia BusinessConnect Code or the same account. If multiple codes or accounts are registered to the same Company, the Promoters will close the account with the fewest Miles earned.
7.8 The Promoters reserve the right to deny Program participation to Companies that do not meet the requirements set out in these Regulations at the time of registration or to exclude them from the Program, canceling Miles earned that have yet to be redeemed at the time the revocation is communicated, as well as to void any Rewards previously obtained but not yet redeemed, if failure to meet the above-mentioned requirements is subsequently revealed following checks by the Promoters. Such checks, to ensure compliance with these Regulations and uncover any fraud, may be made at any time and without informing the Administrator in advance.
ART 8 – MILES FOR COMPANIES
8.1 Miles are the basic unit of calculation used by the Promoters for BusinessConnect. Companies earn Miles by buying Alitalia tickets (055 stock tickets) and taking flights with AZ code operated by Alitalia and/or Airline Partners, as well as when purchasing the goods and services of Commercial Partners.
8.2 The number of Miles earned by a Company for all flight activity is calculated using a multiplier of 7 Miles for each euro spent and flown, excluding taxes ("taxes" refers to airport and security taxes, service fees as well as VAT if applicable). The Promoters reserve the right to communicate improved promotions at specific periods of the year. The calculation is carried out based on individual flights bought by the Company and flown by the holder or by the Company's employees/associates, provided that the Company Code is provided when the flight is booked and purchased. Miles earned are calculated on the basis of the amount spent, divided into each individual leg flown with Alitalia or with Partners, applying the valid multiplier at the time of the flight. For all tickets bought in a currency other than the euro, the official exchange rate used by the Airline will apply.
8.3 If the Company Code is not provided at the time of booking, Miles will not be earned and the Company will not be entitled to Crediting of Missing Miles, unless stated otherwise in the Program regulations, published on the website www.alitalia.com and/or in the Program Communications.
8.4 Miles may not be earned on tickets bought by the Company and not used. Miles earned for using air transport services are credited to the Company’s account only after the flights are taken, according to the timings and conditions specified on the website www.alitalia.com and/or the Program Communications.
8.5 In addition, Miles may not be earned on the following: flights taken with award tickets, charter flights, flights with dedicated group fares, flights flown free of charge or with discounts of over 40% on the applicable fare (excluding taxes and supplements) and/or identified by discount codes ID and AD. Any Miles credited from these flights will be canceled.
8.6 Miles may not be earned on some special fares and/or booking classes on the Airline's flights and/or Promoters' and/or Partners' services and products with particularly discounted rates/prices. The Promoters do, however, reserve the right to award Miles for these special rates/prices during specific promotional campaigns, of which Companies will be suitably notified.
8.7 If the services or products of a Commercial Partner are used, the Company must quote the MilleMiglia BusinessConnect Code when booking the service or purchasing the product. If Miles are not credited for a service or product offered by a Partner, it will be necessary to contact the Partner's Customer Center directly.
8.8 Miles obtained after using Commercial Partner services or products are governed by the rules communicated by these Partners, which are usually posted on their websites (see the links in Appendix A).
8.9 Program Partners are the only parties responsible for the conditions for awarding Miles following the use of their services or the purchase of their products and the related credit. Companies that wish to use Partner services or products are required to check current applicable conditions with the Partners. The Promoters assume no liability for services or products offered by its Partners. Any related complaints must be addressed directly to the Partners.
8.10 Miles may not be traded by Companies nor auctioned or converted into cash. The brokering of the purchase or sale of Miles, the transfer of Miles and the purchase of Miles are also forbidden, except where expressly provided for in the Program regulations published on the website www.alitalia.com and/or in the Program Communications.
8.11 Miles earned by Companies are detailed on their statements, which may be viewed on the website www.alitalia.com. The Administrator is responsible for checking the Company's statements and any complaints may be accepted only if they refer to activities in the month prior to the date of the complaint. The statement is considered to have been approved one month after the last activity. In any event, the Promoters reserve the right to not award or to cancel Miles that are mistakenly credited at any time.
8.12 It is understood that any tax charged that may in any way be connected with the use of tickets or other awards are the exclusive responsability of the Companies.
8.13 The Promoters reserve the right to undertake promotional initiatives or enter into specific agreements through which Miles may be awarded on different grounds and in addition to those provided for in these Regulations. Any such initiatives will be communicated through the website www.alitalia.com and/or through the Program Communications.
8.14 This rewards Program enables Miles to be earned until December, 31 2018. Rewards may be claimed by Companies until January 31, 2019 and will be awarded to the rightful owner at the same time, with the exception of any Rewards that must be delivered to the Company's registered office, in which case the regulations specified on the pages relating to such initiatives on the website www.alitalia.com will apply.
ART. 9 – REWARDS
Miles earned through the Program may be used by Members and Companies to claim the Rewards indicated below.
A – STANDARD AWARD TICKET
9.1 The only person entitled to claim Rewards is the Member, for natural persons, and the Administrator, for Companies. Members (for Companies, the Administrator) may request the Standard Award Ticket (Award Ticket) on Airline flights or flights operated by Program Partner Airlines. Award Tickets are not provided on code-share flights operated by Airlines that are not Program Partners. Any other information relating to eligible flights and other Rewards is provided on the website www.alitalia.com and/or in the Program Communications. Award Tickets may be requested for Economy, Premium Economy and Business classes.
9.2 Award Tickets are valid for twelve (12) months from the date of issue, which cannot be extended under any circumstances.
9.3 Award Tickets may be obtained:
1) By using Miles earned and a payment contribution (corresponding to the value of taxes and supplements), as specified on the website www.alitalia.com.
2) By using Miles alone for the entire sum of the value of the Reward (corresponding to the rate, taxes and supplements) as specified on the website www.alitalia.com.
9.4 Destinations for which and procedures through which Award Tickets may be claimed and the number of Miles needed for the value of the fare for each destination and each service class are shown in the relevant Reward tables, which may be viewed on the website www.alitalia.com (Alitalia Rewards table and Multicarrier Rewards table).
9.5 The payment contribution or number of Miles needed for the value of Award Ticket taxes and supplements vary depending on when the ticket was issued, the pre-selected departure and destination airports and the operating carrier. These are provided online when requesting Award Tickets on the website www.alitalia.com or through MilleMiglia Customer Services (or through the BusinessConnect Customer Center for Companies).
9.6 Award Tickets may be awarded to Members or to other people specified by Members (for Companies, people specified by the Administrator). Award Tickets may not be traded or sold.
9.7 After earning the required number of Miles, Members (for Companies, the Administrator) may book an Award Ticket by visiting the MilleMiglia section of the website www.alitalia.com or by contacting the Customer Center (for Companies, the BusinessConnect Customer Center), specifying that the booking relates to a Reward. Rewards-related bookings cannot be made through the Airline's travel agencies or ticket desk or through third-party travel agencies.
9.8 Bookings will be automatically canceled if the Award Ticket is not issued within the time limit specified at the time of booking.
9.9 Award Tickets requested by telephone from the Customer Center (or the BusinessConnect Customer Center for Companies) will be sent electronically. Any payment contribution must be paid by credit card. Alternatively, Members (for Companies, the Administrator) may collect Award Tickets by going to an Airline ticket office after booking them through the Customer Center (or through the BusinessConnect Customer Center for Companies). In such a case, the payment contribution may also be paid in cash and payment of an issuing fee may be required.
9.10 In the event that the applicant is not the holder of the MilleMiglia account in question, upon issue of the Award Ticket, a copy of the travel documents will be sent to the email address provided in the Member account holder's profile (for Companies, to the Administrator's email address) to confirm that he or she is willing to issue an Award Ticket to a beneficiary, as well as to the address indicated by the beneficiary. Where no email address is available in the Member's or the Company's account profile, it will not be possible to issue Rewards to beneficiaries other than the Member account holder (for Companies, other than the Administrator).
9.11 In the event that the Award Ticket is issued to a beneficiary or customer other than the MilleMiglia account holder, at the time of check-in the beneficiary must present the necessary documentation for the Award Ticket: travel document, a personal identification document, a written proxy signed by the Member account holder (or by the Administrator for Companies), and photocopies of the Member account holder's (for Companies, the Administrator's) identification document and MilleMiglia Card.
9.12 Seats on board Airline flights that are reserved for Award Ticket beneficiaries are limited and availability of Rewards may vary depending on dates, seasons and destinations. The Promoters guarantee that a minimum of two (2) Reward seats will be available once the sale of seats on the flight commences until all seats are sold. Availability of Reward seats on Partner Airline flights is the responsibility of the Partner Airline and not the Promoters.
9.13 For each Award Ticket, a maximum of two (2) layovers (transits) at intermediate airports between the points of origin and destination are permitted. Requested stops (stopovers) are not permitted. In the event of a stopover, two different Award Tickets must be issued. For travel itineraries involving the use of more than one Partner Airline or for flights with Program Partner Airlines, please check the relevant Multicarrier Rewards table, which is available on the website www.alitalia.com.
9.14 Beneficiaries of specific fare discounts (e.g. minors, students, pensioners, etc.) are not entitled to any reduction of the number of Miles required for Award Tickets.
9.15 Under no circumstances will Miles spent on Award Tickets be credited back to a Member's or Company's account, unless the Award Ticket is not used, either in full or in part, due to causes that are attributable to Alitalia and without prejudice to the provisions in the applicable regulations on passenger rights available on the website. In any case where the Award Ticket is not used, or is partially used, Members (for Companies, the Administrator) may request that the Miles used for the value of taxes and supplements or payment contributions be credited back to them.
9.16 The Promoters reserve the right to issue promotional Award Tickets with a limited validity of less than twelve (12) months. Expired Award Tickets cannot be replaced or changed.
9.17 Changes to Award Tickets (in terms of date/time, destination, beneficiary and/or itinerary and/or carrier) may be made, as long as they occur within the Reward's period of validity (if the beneficiary changes, the previously assigned seat cannot be guaranteed). Changes shall be made in return for a cash fee or a deduction in Miles (the relevant amount can be found on the website www.alitalia.com) if required by the type of Reward. If a change in itinerary results in residual Miles, these will be lost and will under no circumstances be refunded to the Member (or Company). Any changes must be made by the MilleMiglia Customer Center (or by the BusinessConnect Customer Center for Companies); any changes made by other offices of the Promoters, the Airline's or third-party travel agencies or other Airlines are not permitted.
9.18 Changes to itineraries and/or the beneficiary of a partially used travel document can only be made by paying a fee, as specified on the website www.alitalia.com, which will require the reimbursement of Miles from the return flight(s) that are not used and the issue of a new corresponding one-way Reward based on the applicable Rewards table.
9.19 Rewards may not be used on Airlines other than those specified on the ticket.
9.20 No changes to the beneficiary may be made and no reimbursement is permitted in the case of an Award Ticket being issued and the subsequent death of the MilleMiglia Member holding it.
9.21 The current Alitalia Conditions of Carriage for Passengers and Baggage apply to the rules on carrier liability in relation to flights operated for the redemption of Rewards (available on the website www.alitalia.com).
9.22 The approximate value of individual Rewards is determined based on air fares in effect at the time the Rewards are issued.
B – SERVICE CLASS UPGRADES (FOR TICKETS OF PAYING PASSENGERS)
9.23 As a Reward, Members (for Companies, the Administrator) may also request a travel class upgrade for tickets purchased for flights (individual legs) operated by the Airline. However, the upgrade depends on the actual availability of Reward seats on board in the superior class. These seats are limited in number. The procedures and the booking classes that allow for an upgrade and the mileage necessary to obtain an upgrade are specified on the relevant pages of the website www.alitalia.com and in the Program Communications. Upgrade requests can only be made once a ticket has been issued and within the specified time frame and according to the applicable procedure. The beneficiary of an upgrade may be the Member and/or a person holding a paid ticket indicated by the Member (or a person indicated by the Administrator). Waiting-list upgrades are not permitted. Miles used for upgrades are non-refundable and no changes to the itinerary and/or date and/or beneficiary are permitted for upgrades that have already been confirmed. Miles credited for flights on which an upgrade was obtained correspond to the amount awarded for that flight in Economy class. The conditions of the original issued ticket remain valid in the event of an upgrade.
C – CHARITY
9.24 Members (or Companies) may use Miles earned to make donations to non-profit and charitable organizations by following the instructions on the website www.alitalia.com and/or in the Program Communications. Donated Miles are non-refundable and will not be credited back to the Member's or Company's account or be available for reuse by the Member or Company under any circumstances. The times and procedures for using this Reward are specified on the website www.alitalia.com and should be checked by Members (or by the Administrator).
D – MILLEMIGLIA GALLERY
9.25 Members (or Companies) can use any Miles earned to claim Reward items and services from the MilleMiglia Gallery online catalog, which is available on the website www.millemigliagallery.com. The times, catalog rewards and procedures for use are specified and regulated on the MilleMiglia Gallery website.
E – CASH & MILES, ADDITIONAL ALITALIA SERVICES, DISCOUNTS, COUPONS, VOUCHERS AND OTHER REWARDS
9.26 Cash & Miles offers the chance to use Miles, in full or in part and from a minimum of 5,000 miles, to obtain discounts on the purchase price of air tickets at the applicable fare on flights operated by Alitalia (code-share flights are not included) or to obtain free tickets.
9.27 Any ticket issued with Cash & Miles is subject to all regulations governing the applicable fare chosen by the Member (or Administrator) during the purchasing stage, and must be used in accordance with the terms and conditions stipulated for this fare. Combining an Award Ticket with the Cash & Miles option [link to the Cash & Miles rules], or vice versa, is not permitted.
9.28 Miles can be earned on tickets issued with Cash & Miles, based on the booking class requested and in accordance with the earning tables in force on the date of the flight.
9.29 Members (or Companies) may also use Miles earned to request additional services available on flights operated by Alitalia, such as extra baggage allowance, Extra Comfort Seats and class upgrades. Additional services may be obtained free of charge using Miles corresponding to the total value for each service.
9.30 The additional services and information about the Miles needed to purchase them must be requested through the MilleMiglia Customer Services (for Companies, the BusinessConnect Customer Center).
9.31 For all matters not expressly addressed in these Regulations, please see the Terms and Conditions of the initiatives, which are available on the website www.alitalia.com.
9.32 MilleMiglia coupons and vouchers are deemed to be Rewards.
9.33 The Promoters reserve the right to offer other Rewards or other opportunities to use Miles, giving the relevant terms and conditions on the website www.alitalia.com. They also reserve the right to establish promotional initiatives for the awarding of Rewards or the use of Miles that have a limited duration or are reserved for Members with Exclusive Club membership or co-brand card holders.
ART. 10 – RULES OF CONDUCT AND SANCTIONS
10.1 Members' or Companies' participation in the Program is subject to compliance with all the conditions and rules of conduct specified in these Regulations.
10.2 In particular, Members and Companies are prohibited from behaving in a manner that is improper, indecent, disrespectful or offensive toward employees of the Promoters or the Program Partner Airlines, companies or other entities, or from any inappropriate behavior on board an aircraft or in areas reserved for Members, or from refusing to follow instructions given by employees of the Airline or Program Partner Airlines, companies or other entities.
10.3 Members and Companies may not falsify or modify the information relating to their participation in the Program in any way, and may not issue false or misleading statements or provide false or misleading information in order to gain advantages they are not entitled to.
10.4 Members and Companies are prohibited from any conduct censored by these. In particular, any form of sale of Miles is prohibited, except where expressly provided for in the Program Regulations.
10.5 The purchase or sale of Rewards, the unauthorized use or acquisition of Rewards are also forbidden.
10.6 The Promoters reserve the right to carry out, at any time and without prior notice, checks on Members' and Companies' accounts, with particular focus on the correct earning of Miles, the use of these Miles and the use of Rewards based on Alitalia services or Partner services. The Promoters also reserve the right to claim any damages caused by the improper use of the card, Miles or Rewards.
10.7 The Promoters reserve the right to exclude Members or Companies from the Program, retain Cards, including the Freccia Alata Per Sempre Card, and to cancel Miles earned that have not yet been redeemed at the time at which the exclusion is notified, and to void any Rewards obtained previously but not yet used when Members or Companies do not comply with all of the conditions in these Regulations and/or when their conduct does not conform to the Regulations or the law, the Conditions of Carriage of the Airline or Partner Airlines or, more generally, any other applicable rules or provisions or anything likely to cause damage to the Promoters or Partners. The Promoters also have the right to suspend the Member's or Company's MilleMiglia Card, if objective evidence gives just cause, while they take the necessary time to investigate the case. While the investigations are ongoing, the Member or Company in question may not be permitted to use Miles or enjoy the benefits and services associated with the Program.
10.8 Any abuse or violation of the rules in the Regulations, fraud or misleading statements are subject to appropriate administrative and/or legal actions on the part of the competent governing authorities and the Promoters.
ART. 11 – PROGRAM PARTNERS
11.1 The list of Program Partners for Members and for Companies is provided in Appendix A of these Regulations and can be viewed on the website www.alitalia.com and/or in the Program Communications. Any change will be promptly communicated to Members and Companies by the Promoters, on the understanding that under no circumstances will the exclusion of a Partner from the list mean that Miles earned with the services provided by the Partner are lost.
ART. 12 – PERSONAL DATA PROCESSING
12.1 In view of the role of Program Co-promoter and Manager assumed by Alitalia Loyalty S.p.A., pursuant to Article 5 of Italian Presidential Decree no. 430/2001, Alitalia Loyalty should be considered the co-Data Controller with Alitalia of data relating to customers registered on the MilleMiglia Program, pursuant to and for the purposes of Article 28 of the Privacy Code (Italian Legislative Decree no. 196/2003 as subsequently amended and supplemented). The aforementioned companies have an equal interest in relation to the Program's objectives and equal decision-making authority on management of the same.
12.2 As Alitalia Loyalty's main objective is to manage and develop services related to the customer loyalty Program, Alitalia has named Alitalia Loyalty as the Data Processor pursuant to and for the purposes of Article 29 of the Privacy Code, with particular regard to the role of Program manager and customer relations. At the same time, Alitalia Loyalty has named Alitalia as the Data Processor, with particular regard to management of infrastructure, systems and security measures.
12.3 All personal data supplied at the time of registration and subsequently shall be processed by the Holders in accordance with the applicable laws and regulations on personal data protection and in particular in accordance with the Privacy Code.
12.4 Personal data must be processed in order to manage Members' participation in the Program, to allocate any Rewards, as well as other benefits and related services associated with their participation in the Program and their Cardholder status, in accordance with these Regulations. The Holders will also process particular data categories that Members supply when registering for the Program on the website www.alitalia.com. This information relates to meal preferences and assigned seats on flights operated by Alitalia and Partners. This information is useful for offering Program Members a more personalized service. By selecting their preferred options and registering for the Program on the website www.alitalia.com, Members give their consent for the Holders to use any data that may disclose aspects such as their health status, potential religious affiliation and possible membership of a particular ethnic group (e.g. when Members choose a diabetic meal or a kosher menu). This data will only be used to provide Members with personalized service. Data may occasionally be disclosed to third-party service providers (such as check-in operators other than Alitalia) for the aforementioned purposes only. The disclosure of such data is optional and any failure to supply it will have no consequences in relation to Members' registration for and participation in the Program.
12.5 The correct performance of the above-mentioned data processing activities implies that Members' personal data may be accessed by the Holders' sales staff and by third-party service providers in the context of the Program (for example, direct marketing companies and market analysts, Customer Centers, standardization companies, IT service providers or customer care service providers) for purposes strictly related to and instrumental in managing the Program and, subject to Members' prior consent, for purposes of commercial communications. The Holder's sales staff shall act as data supervisors for the Holders, whereas the latter companies shall act as processors of such data. A list of third-party companies providing services associated with the Program, and responsible for processing Members' personal data, is available from the Holders' offices. The Holders shall ensure that the personal data in question is processed in accordance with the principles of necessity, lawfulness, accuracy, quality of data and proportionality and, in any case, ensuring data confidentiality. Data will be processed electronically, manually or in paper form, and will consist of the comparison, classification and calculation of the data, as well as of its sorting and classification into lists, all in accordance with the minimum security requirements to protect the confidentiality of the subject to which the data refers and to avoid the risk of it being accessed by unauthorized third parties. All data, grouped into categories and/or clusters in anonymous form, may be used in the Holders' statistical analyses to check the marketing preferences of its customers. The Holders also ensure that any personal data relating to Program Members is used exclusively for purposes related to participation in the Program and for sending organizational information to Members regarding their Membership status and possible expiration of benefits associated with the Program. All data provided by Members at registration and/or subsequently may also be used, subject to the Member's consent, for sending commercial communications and for direct marketing purposes, as well as, and always subject to the Member's consent, for profiling and market research purposes. Any disclosure or dissemination of data not required by legislation or not expressly authorized by Members is hereby excluded.
12.7 Personal data will be processed throughout the Program and its subsequent editions, within the terms and conditions set out in these Regulations, and will be stored after its expiration and/or a Member's withdrawal for the exclusive purpose of handling complaints and administrative/accounting disputes. After the expiration of or withdrawal from the Program, data will be kept for the statutory period of limitation applicable to Members' rights. Nevertheless, personal data will be kept for profiling or direct marketing purposes for a period not exceeding 12 and 24 months, respectively, from when it was registered, unless it is effectively anonymized to prevent the identification of those involved, even if indirectly or by linking with other databases. Any personal data that does not require archiving in relation to the purposes for which it was processed will be deleted or anonymized by both the Holders and any third parties to which it was disclosed for the aforementioned purposes.
12.8 On registering for the Program, all personal data marked by an asterisk (*) must be provided in order to fully participate in the Program and related initiatives, and to fulfill any legal requirements. Any refusal to provide the requested personal data, whether in part or in full, during the implementation of the Program, may prevent the Holders and third-party service providers acting within the context of the Program from fully implementing or correctly fulfilling any obligations arising from the Program. On the other hand, supplying personal data other than that marked by an asterisk (*) is optional and any failure to supply it will not affect the Member's registration or participation in the Program in any way.
12.9 Members will be given the appropriate information on the processing of their personal data that is collected for the sole purposes of the Program. Consent will be requested for each purpose separately, if required by law. Specifically, Members are entitled to freely express their choices on the processing of their personal data, whereby they may also state their wishes for each of the identified purposes, such as the mailing of any commercial communications, including all of the Program Communications, with the exception of organizational communications directly related to the Member and the expiration of benefits. Members may change their data, indicated preferences and consents provided, at any time, by updating their MilleMiglia profile in the section dedicated to the Program on the website www.alitalia.com or by contacting the Customer Center.
Personal data processing operations will also be dedicated to functional and/or necessary activities for managing BusinessConnect, as information about individual professionals owning single-person Companies or telephone contact numbers or addresses linked to the registered Company could be collected.
12.10 Members have the right, at any time, to obtain confirmation of the existence of their personal data, to know its contents and origin, to check its accuracy or request that it be supplemented, updated or rectified. Members also have the right to request its deletion or conversion into an anonymous form, or for any data processed in breach of the provisions of the Personal Data Protection Code to be blocked, and object in all cases to its processing for legitimate reasons, by sending a signed written request and attaching a copy of a valid identification document to Alitalia at firstname.lastname@example.org, who will respond in conjunction with Alitalia Loyalty.
The Holders have the right to identify new and different ways of exercising the rights referred to in Article 7 of Legislative Decree 196/03; in such a case, users will be made aware of the new procedures through the MilleMiglia section of the website www.alitalia.com and through other dedicated communications to individual Members.
The Italian Data Protection Authority has provided a form "Esercizio dei diritti in materia di protezione dei dati personali" (exercising of personal data protection rights), which is available online via the Authority's website.
12.11 To withdraw from the Program, Members must provide a written request that specifies the MilleMiglia Code and must also attach a countersigned copy of a valid identity document. The request must be sent to the email address email@example.com or to the Customer Center fax number +39 06 65627132/7133. Any Miles that remain on the account and that have not yet been used will be canceled when the card is closed.
ART. 13 – SUSPENSION OR EARLY TERMINATION OF THE MILLEMIGLIA PROGRAM
13.1 The Promoters may temporarily suspend or terminate the Program before the expiration date indicated in Article 4.23 only with just cause, in accordance with Articles 1989 et seq. of the Italian Civil Code.
13.2 The Promoters will notify Members and Companies of the temporary suspension of the Program or the early termination of the Program via the website www.alitalia.com and/or in the Program Communications. In the event of the early termination of the Program, the Promoters undertake to give Members and Companies at least thirty (30) days' prior notice, while suspension of the Program may be communicated immediately after it occurs, on the understanding that the Promoters will strive to communicate both of these to Members and Companies as early as possible.
13.3 In the event of early termination of the Program, Members and Companies will be entitled to use Miles earned for six (6) months after the date of the termination. In any case, the early termination of the Program will not enable the use of Miles to claim Rewards after March 31, 2018, regardless of the date on which the termination of the Program occurs as this date represents the final date on which Rewards may be claimed with the current edition.
ART. 14 – REFERENCE TO APPLICABLE AND CONFLICTING LEGISLATION
14.1 For anything not expressly provided for or governed by the present Regulations, reference shall be made to applicable legislation, with special reference to Italian Presidential Decree no. 430 of October 26, 2001 (published in Official Journal no. 289 of December 13, 2001) on "Regulations concerning the revision of the rules governing competitions and reward programs, as well as local events pursuant to Article 19, paragraph 4, of law no. 449 of December 27, 1997."
14.2 In the event of any conflicts between the provisions of these Regulations and the above-mentioned decree, the latter shall prevail.
